Terms of Service

Rules governing your access to and use of the FirstAdvice platform.

1.Definitions

  • "FirstAdvice" means the operator of the FirstAdvice platform.
  • "User" means any individual or entity accessing or using the Platform.
  • "Expert" means any independent professional, consultant, or advisor offering services through the Platform.
  • "Services" means any feature, consultation facilitation, communication tool, referral mechanism, or other offering made available through the Platform.

2.Nature of the Platform

FirstAdvice is a technology platform that facilitates connections between users and independent experts across legal, taxation, finance, education, career counselling, automobiles, technology, consumer matters, real estate, and other advisory domains.

FirstAdvice does not itself provide professional advice, legal services, financial services, or any other regulated professional service unless expressly stated otherwise. Any professional engagement arising between a user and an expert shall be independent of FirstAdvice.

3.Eligibility

By using the Platform, you represent and warrant that:

  • You have the legal capacity to enter into a binding agreement
  • The information provided by you is true, accurate, and complete
  • Your use of the Platform complies with all applicable laws and regulations

Where a user is below the age of 18 years, use of the Platform shall be subject to applicable law and, where required, parental or guardian consent.

4.User Accounts

Certain features may require registration. Users are responsible for:

  • Maintaining the confidentiality of account credentials
  • Restricting unauthorized access to their accounts
  • Ensuring that information provided remains accurate and updated

Users shall be solely responsible for all activities conducted through their accounts.

5.User Content

By submitting queries, messages, documents, or other content, you represent and warrant that the content is accurate, lawful, and does not infringe any third-party rights.

Users shall not upload or transmit content that:

  • Is unlawful, fraudulent, misleading, defamatory, obscene, or offensive
  • Violates intellectual property rights
  • Contains malicious software, viruses, or harmful code
  • Violates privacy rights or confidentiality obligations

FirstAdvice reserves the right to remove, restrict, or refuse any content at its sole discretion.

6.Experts and Consultations

Experts available through the Platform are independent third parties and are not employees, agents, or representatives of FirstAdvice.

FirstAdvice does not warrant the qualifications of any expert, the accuracy of any expert information, the suitability of an expert for a particular matter, or the outcome of any consultation. Users are solely responsible for independently evaluating any advice, information, or service obtained through the Platform.

7.No Professional Relationship with FirstAdvice

Use of the Platform does not create:

  • An advocate-client or attorney-client relationship
  • A consultant-client or fiduciary relationship
  • An agency, partnership, or employment relationship

Any professional relationship shall exist solely between the user and the relevant expert.

8.Payments

Certain services may require payment, which may be collected by FirstAdvice, third-party payment processors, or paid directly to experts. FirstAdvice reserves the right to introduce, modify, or discontinue pricing structures at any time.

9.Refunds and Cancellations

Unless otherwise expressly stated, all payments are non-refundable. FirstAdvice may, at its sole discretion, consider refund requests in exceptional circumstances such as technical failures or duplicate payments. Dissatisfaction with advice or services provided by an expert shall not automatically entitle the user to a refund.

10.Disclaimer of Warranties

The Platform and all services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, FirstAdvice disclaims all warranties — express, implied, or statutory — including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and uninterrupted operation.

11.Important Professional Disclaimer

Information, consultations, and recommendations provided through the Platform are intended for general informational and consultative purposes only. They are not a substitute for obtaining independent professional advice tailored to your specific circumstances. Users remain solely responsible for evaluating and relying upon any information or service obtained through the Platform.

12.Limitation of Liability

To the maximum extent permitted by applicable law, FirstAdvice and its owners, directors, officers, affiliates, and representatives shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Platform.

In any event, the aggregate liability of FirstAdvice shall not exceed the amount paid by the user to FirstAdvice in the six (6) months preceding the event, or INR 5,000, whichever is lower.

13.Indemnity

Users agree to defend, indemnify, and hold harmless FirstAdvice, its owners, directors, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, and legal fees arising from the user's use of the Platform, violation of these Terms, violation of any law, infringement of third-party rights, or disputes between users and experts.

14.Intellectual Property

All rights, title, and interest in and to the Platform — including its software, design, branding, trademarks, logos, text, graphics, and underlying technology — are owned by or licensed to FirstAdvice. Users shall not copy, reproduce, distribute, modify, reverse-engineer, or otherwise use any part of the Platform without prior written authorization.

15.Third-Party Services

The Platform may integrate with third-party services, websites, payment processors, or external resources. FirstAdvice does not control and is not responsible for the availability, content, security, or practices of such services. Use of third-party services shall be subject to their respective terms and policies.

16.Suspension and Termination

FirstAdvice reserves the right, at its sole discretion and without prior notice, to suspend or terminate user accounts, remove content, restrict access, or refuse services where it believes a user has violated these Terms, applicable law, or engaged in conduct that may harm the Platform or its users.

17.Force Majeure

FirstAdvice shall not be liable for any delay or failure to perform obligations resulting from events beyond its reasonable control, including natural disasters, governmental actions, war, terrorism, labour disputes, internet outages, cyberattacks, power failures, or epidemics.

18.Governing Law, Dispute Resolution & Jurisdiction

These Terms shall be governed by the laws of India. Any dispute shall first be attempted to be resolved amicably through good-faith discussions. If unresolved within 30 days, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat and venue at New Delhi, India, conducted in the English language. Subject to this, the courts at New Delhi shall have exclusive jurisdiction.

19.Modifications

FirstAdvice reserves the right to modify, update, or revise these Terms at any time. Updated versions shall be published on the Platform with the revised effective date. Continued use of the Platform following publication of revised Terms shall constitute acceptance of such revisions.

20.Entire Agreement

These Terms, together with the Privacy Policy and any additional policies published on the Platform, constitute the entire agreement between the user and FirstAdvice regarding the use of the Platform. If any provision is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
